Judicial decisions9/7/2023 ![]() ![]() While on the one hand the majority of contemporary literature either advocates for or presupposes a rigid distinction between discovery and justification, on the other hand this distinction is being challenged by those who defend that such a distinction is unachievable, undesirable, or both. The objective of this article is to analyse and clarify the conceptual framework that permeates the debate about the distinction between discovery and justification in legal decision-making. ![]() This six-fold classification enables us to move forward from debating whether discovery and justification can be rigidly separated, towards articulating how each element (reasons, acts, and processes) has a role to play in each of the contexts (discovery and justification), and how these elements and contexts are related. I propose a six-fold classification, through which we can identify reasons, acts, and processes that play a role both in the context of discovery and in the context of justification. The article argues that merely distinguishing between ‘discovery’ and ‘justification’ is not precise enough, and that we should make a distinction between different elements within each of these contexts. ![]() This article shows that this debate is being muddled because of differences and ambiguities in the way that different writers use the terms ‘discovery,’ ‘justification,’ and related terms. In jurisprudence, a debate exists about the possibility and desirability of a rigid distinction between discovery (how a judge actually reaches a decision) and justification (how a judge publicly justifies a decision). ![]()

![]() A man of diverse talents, Ewing almost single-handedly revitalized the Joffrey Ballet during his tenure as general director in the 1960s. In 1988 he established the Lucia Chase Endowed Fellowship for Dance at the School, in memory of his mother, a co-founder and principal dancer with American Ballet Theatre. ![]() Ewing had been associated with the School since 1985, when he became chairman of the Board of Visitors. Nelson, former Dean of music at Yale University, who served as Interim Chancellor during the 1989–90 school year. He assumed the position in July 1990, following Philip R. Milley became Chancellor at the School of the Arts in September 1984. The Stevens Center remains UNCSA's largest performance facility. Attendees included Agnes de Mille, Cliff Robertson, Governor James Hunt, President and Mrs. The gala opening of the Stevens Center featured the school's symphony orchestra conducted by Leonard Bernstein, with Isaac Stern as soloist and Gregory Peck as the Master of Ceremonies. During his time at UNCSA the Workplace building, containing the Semans Library, was opened on the UNCSA campus, as well as the Stevens Center, previously the Carolina Theatre, in downtown Winston-Salem. In the above photo, we have removed the back (right) side panel, rubber grommet inserts line the holes for cable management, the CPU motherboard cutout plate and an extra SSD mounts reveal themselves as well as the FAN and LED lighting HUB. There's enough clearance on the glass so there aren't any tension issues or anything. The tempered glass is mounted onto rubberized risers and then secured with four screws. The four feet have been updated to a bit of a new design, these are rubberized giving more grip to the surface and again preventing resonating noises escaping from the PC. And yes, it's incredibly glossy and reflective (as you can see). I'll show you that in the photo shoot of the build later on. And in a dimmed room it actually works really well. Overall, once mounted shut, you can hardly see that color. Now, the photo does make it look worse than it really is. The cover is blocking the view of the PSU (mission accomplished!), but inside that cover the PSU will sit on four rubberized pads, to ensure that no vibrations/noise passes on to the Dark Base 900 frame. ![]()
